U.S. Solicitor General Elizabeth Prelogar has begun detailing her case for why Tennessees S.B. 1 is discriminatory on the basis of what she describes as biological sex. She argues that because testosterone and estrogen have different effects in those assigned male at birth versus assigned female at birth, and due to these medications differing based on said assigned sex, restriction constitutes sex-based discrimination.Supreme Court Justice Clarence Thomas, Justice Samuel Alito, and Chief Justice John Roberts began their line of questioning. Alito cites the infamous Cass Review in his line of questioning, the infamous United Kingdom report that has been used to restrict puberty blockers in the country. It has been criticized by the World Professional Association on Transgender Health as well as researchers at Yale for being unscientific.Justice Thomas asks for clarity on the specific effects of each medication on youth, while Roberts asks for specific clarity on the role SCOTUS should play in regulating individualized care, and whether it should be left up to the states to decide.Prelogar argues the core that S.B. 1, regardless of other arguments or details, is discriminatory and that no medication has been completely restricted in other countries.All three justices that have begun their line of questioning were appointed by Republican presidents.This is just one update in a bigger story.
