Sam Alito brings up restrictions on womens rights to oppose trans care
Supreme Court Justice Samuel Alito argues that previous SCOTUS rulings, Dobbs v. Jackson Womens Health Organization (the decision that overturned Roe v. Wade) and Geduldig v. Aiello (which allowed the denial of insurance benefits from work loss due to pregnancy) do not support the claim that S.B. 1 is sex-based discrimination, as both rulings suggested that pregnancy coverage restrictions in insurance and abortion restrictions are not sex-based discrimination.Prelogar argues that both rulings do not suggest what Alito believes, arguing that they refer to more individualized care that is irrelevant to the specific features of hormone replacement therapy and puberty blockers, which are based on sex-based characteristics and therefore circumvent the arguments made in those previous rulings.Justice Sonia Sotomayor began speaking, echoing arguments made by Prelogar that this issue is inherently based on sex classification. She also echoes her criticisms of the Cass Review, as well as responses to Alitos claims that European countries have restricting care, pointing out the inaccuracy of those statements.
