Justice Jackson argues trans ban is discriminatory; Chase Strangio speaks & makes history
In conjunction with a line of questioning from Justices Elena Kagan and Amy Coney Barrett, Justice Ketanji Brown Jackson draws up an example to show how denying trans people medical care is discriminatory, as this same care is often granted to cisgender individuals. Jackson makes a comparison between discriminatory policies implemented in the 1950s and 1960s on the basis of race, bringing up Loving v. Virginia, which overturned bans on interracial marriage.U.S. Solicitor General Elizabeth Prelogar echoes this argument, drawing parallels between the logic given in Loving and in the current argument.Shortly after this, Chase Strangio, the first openly trans lawyer to speak in front of the Supreme Court, begins arguing in favor of overturning S.B. 1. Strangio is with the American Civil Liberties Union and has previously presented in representation of the plaintiffs. Justice Clarence Thomas asks Strangio what his proposed solution would be, to which he responds that he would want to allow gender-affirming care for minors to be authorized, especially for his plaintiffs.This is just one update in a bigger story.
