Judge Victoria Calvert agreed with the plaintiffs that the blanket ban violated the Eighth Amendment, which bars cruel and unusual punishment.The Court finds that there is no genuine dispute of fact that gender dysphoria is a serious medical need, Judge Calvert wrote in her opinion. Plaintiffs, through their experts, have presented evidence that a blanket ban on hormone therapy constitutes grossly inadequate care for gender dysphoria and risks imminent injury. Related Trump just told inspectors to stop tracking anti-LGBTQ+ prison rapes Georgia Senate Bill 185 was signed into law in May by Governor Brian Kemp (R). The bill prohibited state funds and resources from being used to provide gender-affirming care to inmates in Georgia prisons. That included hormone replacement therapy (HRT), as well as sex reassignment surgeries or any other surgical procedures that are performed for the purpose of altering primary or secondary sexual characteristics, and even cosmetic procedures or prosthetics intended to alter the appearance of primary or secondary sexual characteristics.The bill took effect in July, andfive plaintiffs filed a lawsuit against it in August. In addition to arguing that SB 185 constituted cruel and unusual punishment, the lawsuit also claimed that it violated the Equal Protection Clause. HRT and other gender-affirming care treatments were not banned under the bill for all inmates, only for those who were trans. The bill also prohibited trans inmates from paying for the care themselves while incarcerated. So why would we allow Georgia to cut off medically required care for people with a similarly serious diagnosis of gender dysphoria?SB 185 was a blanket ban that overruled the opinions of judges, doctors, and the Georgia Department of Corrections, all of whom have previously acknowledged that gender-affirming care is medically necessary for incarcerated trans people. While the judges ruling makes it clear that not every inmate is entitled to gender-affirming care, it puts those decisions back in the hands of medical professionals and the patients rather than having the legislature make medical decisions for trans people.The Court requires healthcare decisions for prisoners to be made dispassionately, by physicians, based on individual determinations of medical need, and for reasons beyond the fact that the prisoners are prisoners, the judge said in her ruling.Current estimates suggest that there are around 300 out trans people incarcerated in Georgia state prisons. After the ruling, the Department of Corrections filed a notice of appeal with the 11th Circuit Court of Appeals.This sort of case has been litigated for over twenty years now. In 2005, Wisconsin introduced a ban on doctors providing trans inmates with gender-affirming care, affecting inmates who had been on hormones since the early 90s. While it's not the great film the first Wicked was, Erivo and Grande's performances are enough to lift it and make it a terrific theater-going experience.At number eight is Bill Condon's musical Kiss of the Spider Woman, starring Out cover stars Jennifer Lopez and Tonatiuh, along with Diego Luna. The high-budget musical is one of the most gorgeous films of the year, and is a true treat for fans of musicals and cinema.Our fifth-best movie of the year is Ira Sachs's understated historical drama Peter Hujar's Day. The film stars Ben Wishaw as the famous photographer and takes place over a day as he has an intimate conversation with his friend, writer Linda Rosenkrantz (Rebecca Hall)Number three is Zackary Drucker's vital documentary Enigma, about former models and cabaret performers, April Ashly and Amanda Lear. Greenes response felt like a departure from her November statement on CNN, where she said, I would like to say humbly, Im sorry for taking part in the toxic politics. I hope President Trump can do the same.Many praised her for taking these steps, while others expressed caution about readily accepting her radical, quite sudden transformation as real. I dont know who they are.I stood for women who were raped when they were 14 years old, and the president that I fought for for five years called me a traitor for that, so that changed the landscape of things, Greene said.She said she resigned after Trumps public insults toward her led not only to death threats against her but also against her son. When she sent the threats to Trump, she said his response was extremely unkind, but wouldnt share details. But some have found it both ironic and infuriating that Greene cowered under the threats so easily, considering the hate she has perpetuated throughout her time in Congress has no doubt led to similar threats against a myriad of people and groups such as LGBTQ+ people, who she has repeatedly called pedophiles and child abusers.Greene has a long history of anti-LGBTQ+ and particularly anti-transgender rhetoric. She has made opposing LGBTQ+ equality one of the centerpieces of her time in Congress, evenintroducing a bill that would bangender-affirming care for trans youth and make it harder for adults to obtain by banning any federal money from being spent on supporting gender-affirming care.Greene has attempted to add anti-transgender provisionsto numerous budgetary bills to prevent federal agencies fromeven posting about LGBTQ+ rights on social media. She has demonized transgender women asthreats to cisgender womenand believes cis women have a right to not share gender-segregated spaces like restrooms with trans women. After Greene announced her resignation, Rep. Jasmine Crockett (D-TX)scorned her for cowardice. Youre on the other side of the president for one week, and you cant take the heat? Imagine what it is to sit in my shoes, to not only be on the opposite side of him, but to have people like her who are constantly fanning the flames of hate, and imagine what those threats look like when you literally are someone like me.She pointed out that many other Republicans who have pushed for the release of the Epstein files have been able to handle Donald Trumps wrath.Marjorie has been an instigator of a lot of this hate that we see as it relates to the MAGA movement, Crockett continued. Its just interesting that I dont know if she really fully understood how bad she was making it for other people, and now that theyre doing it to her Why is it that everyone else is able to stand it and you cant?Greene also said that so many Republicans hate Trump but started kissing his a** once it was clear hed be the partys 2024 candidate. Hes certainly pushed forward plenty of anti-trans talking points through his campaign ads, executive orders, stacking of the Supreme Court, and pressure on legislatures. But while hes certainly become a figurehead for the movement in some ways, it seems its not something he truly cares about on its own merits. And when hes gone, the anti-trans movement will still remain, and they wont be as powerless without him as we might hope: Other countries are already showing us how this might play out. Related National security expert says second Lavender Scare is here as govt purges LGBTQ+ workers The anti-trans movement rose alongside Trump, and he certainly used it to his own ends: He has used it as a distraction from other issues and to drive his cult. He has done massive damage using it, but he never created or defined the anti-trans movement. Anti-trans bills started being proposed in legislatures in 2015, with just 19 bills the year before Trump won his first election, to 1,012 bills this year.When Trump leaves office a third term isnt truly likely, and his health might not see him to the end of his current term some of the anti-trans measures will likely fall away. When Biden took office, he reversed Trumps first trans military ban, and that will likely be the fate of the current ban under the next Democratic president. Other things, especially those based on Supreme Court rulings, will likely take longer to shift. Subscribe to our Newsletter today But expecting all of that to happen overnight, or without a fight, would be to ignore the true nature of Trumps anti-trans agenda. Its not something hes pushing because he has any genuine feelings about girls sports, but because he is enabling those who stand behind or around him to move their own needles.Weve seen his willingness to follow the lead of someone like Russ Vought, one of the authors of Project 2025, when it comes to massive government budget matters. Alliance Defending Freedom and the Heritage Foundation have been behind a huge number of anti-trans bills, messaging, and the general rhetoric that has done so much harm to our community. The organizations and individuals who are behind these bills are true believers in their cause that is, its not 100% political strategy. And while Trump leaving will be a challenge for them, they wont be going anywhere. For an idea of just how much of this anti-trans hate is going to stick around not just in impotent rage but in very real harm we can look overseas, especially to Britain. One of the United Kingdoms leading exports to the United States over the past few years has been its transphobia. (Maybe Trump could put a tariff on it, then people might stop buying it?) The UKs anti-trans wave ranges from J.K. Rowlings hate and popularizing hiding anti-trans attacks under the guise of defending women and lesbians, to the now-infamous Cass Review, which as been used as the basis for gender-affirming care bans in the U.S. and was mimicked by the Health and Human Services report in May, which cited Cass 149 times.The UKs Conservative Party was in power from 2010 to 2024. Like Trump, they presided over the rise of anti-trans rhetoric, and were campaigning on excluding trans people from public life in the election they eventually lost. It was under their government that the Cass Review was commissioned. The new Labour government, which has more recently taken power, has been weak on supporting the trans community, but has also been less obviously anti-trans. Despite that, there has been massive damage to the community during the conservatives relatively short tenure. The UK Supreme Court ruled that the countrys 2010 Equality Act was based on biological sex, and that public womens spaces and political quotas for women were not for trans women. The UKs Equality and Human Rights Commission (EHRC) then put out guidance suggesting the exclusion of trans people from single-gender spaces. A leaked proposed update to that guidance wouldve advised business owners to ban people from single-sex spaces based on appearance.This week, both the Girl Guides (the British version of Girl Scouts) and the Womens Institute (a womens organization that has allowed trans women for over 40 years) have now banned trans women and girls from membership. While both groups have indicated they regret having to make the decision, they have said it is necessary to comply with EHRC and avoid legal battles.It was revealed in November that the Guides have been facing legal action from a parent over their inclusion of trans girls. The parents lawyer said Girlguiding cannot simultaneously rely on an exemption that allows it to provide a female-only association and charity under the Equality Act, while redefining girl and woman to include biological males. This is legally and linguistically incoherent. It is unlawful and should be immediately withdrawn. But while all of this has taken place under the Labour government, it wasnt because they were pushing for it. The case that went to the Supreme Court was made by For Women Scotland, and it received over a third of its legal funding from the noted transphobe JK Rowling. Similarly, the lawsuit against the Girl Guides is reportedly supported by Maya Forstater, an ally of Rowling who went to court claiming that her gender critical beliefs were a protected class that she couldnt be fired over.The UKs anti-trans movement isnt driven by politics, the leading party, or the prime minister. Its driven by money and hate. The UK hasnt been saved by having a politician who doesnt hate, but it might be doomed by a party that wont push to institute protections for the trans community.For trans people to survive in the United States, we dont just need to be rid of Donald Trump: He wont take the anti-trans movement away with him when he departs. We need to be rid of the middle ground politicians who want to sit on the fence while trans lives are in jeopardy. We need leaders who will establish strong, real protections in the law. That doesnt seem likely under our current political system and with Democrats who want to waiver on trans sports issues because they worry it will alienate hard right voters. WWW.LGBTQNATION.COMFlood of retirement announcements expected soon from frusterated GOP House membersThe U.S. House of Representatives may soon see a mass exodus of Republican lawmakers who are frustrated with their partys inability to pass legislation and are anticipating Democrats retaking the chamber next year.Multiple Republican lawmakers and aides have said they expect the retirement announcements to start pouring in over the coming weeks, with one insider estimating as many as 20 House Republicans throwing in the towel, according to a recent report in Puck. Thats on top of the 23 Republican representatives who have already announced they are retiring or running for other offices. Related GOP Rep. warns mass exodus of House Republicans is imminent: Morale has never been lower As Pucks Leigh Ann Calswell reports, many of the Republicans who have already announced plans to retire are significantly younger than the Democrats who have announced theirs. Democratic Reps. Jan Schakowsky (IL), Danny Davis (IL), Jerry Nadler (NY), Bonnie Watson Coleman (NJ), Dwight Evans (PA), Nydia Velzquez (NY), and former Speaker Nancy Pelosi (CA) are all in their 70s and 80s, while Reps. Jodey Arrington (TX), Troy Nehls (TX), and Morgan Luttrell (TX) are all in their 50s.Republicans in the House, Calswell writes, are frustrated by their partys lack of an agenda since passing Trumps so-called One Big Beautiful Bill with Speaker Mike Johnson (R-LA) ceding congressional power to the president, along with the disruptive antics by far-right representatives and the partys inability to pass legislation. This Congress has only gotten 46 bills signed into law compared to the last Congresss 274, which was already reportedly the least of any Congress since 1973. Nancy Mace (R-SC) has been so frustrated with Johnsons leadership that she was planning to huddle with Representative Marjorie Taylor Greene of Georgia to discuss following her lead andretiring earlyfrom Congress. Mace, who is currently running for governor of South Carolina, later denied that she was considering resigning. While she told Calswell that she is tired of the party having to resort to filing discharge petitions to get its agenda passed because Johnson is reluctant to move bills forward, she said she is going to try to stick it out for the remainder of her term. After Greenes announcement last month, one senior House Republican toldPunchbowl News that more explosive early resignations are coming.Its a tinder box. Morale has never been lower. Mike Johnson will be stripped of his gavel and they will lose the majority before this term is out, the anonymous Rep. said.The wave of Republican retirements is not expected to affect the partys slim majority, as most are expected from members in safe districts. So far, Rep. Don Bacon (R-NE) is the only Republican member from a swing district who has announced his retirement. But, Calswell suggests, another reason so many Republican members are heading for the door may be that they expect Democrats to retake the House next year. A recent Gallup poll showed President Donald Trumps approval rating at 36 percent, while approval for the GOP-led Congress was at just 14 percent.
